Terms and Conditions
The scope refers to the online shop www.musterAG.com, operated by Cassandra Bahreman Schock, Buchgrabengasse 19, A-3003 Gablitz, Austria/Europe and the Purchasers. For orders that come through the online shop apply the following General Terms and Conditions.
The place of fulfillment for all businesses is the company location.
Contract, order and business language is German.
2. Offer & Order
a) The articles are available on the website musterAG.com and can be ordered through the online shop by clicking the button “order”, or by e-mail. On receipt of the order by e-mail Purchaser is notified. The articles will be produced possibly and sent, after agreement of an order and prepay. They are individual (printed as size, color and type of T-shirts with the desired motif) according to customer-made products.
b) Individual requests regarding the type and color of the printed article, or individual wishes regarding the motives (or other custom colors) are always possible. This requires a custom quote from musterAG.com and a written order of the Purchaser. A withdrawal from a special contract is only possible if there is a legal basis (eg, material defects, etc.) for it.
a) Payment is made in advance by credit card or bank transfer. The order will be processed only after receipt of payment at musterAG.com.
b) For regular clients individual payment arrangements are possible, the agreement requires a written form.
The delivered goods will be our property until full payment has been received from the business relationship with the Purchaser.
4. Delivery & Shipping
a) The estimated delivery time will be displayed in the respective article or announced at the time of the offer. It usually takes 3-7 business days for the EU area and 2-3 weeks for the US and Canada for stored items. For non-stocked goods, the delivery time is extended by 7-21 working days, depending on the nature and timing of the order. In special cases, such as with a high order volume or with individual wishes the delivery time can be extended. The delivery time begins to run as soon as all order details have been clarified and the agreed advance payment has arrived on our account.
b) We deliver to all EU countries, Switzerland, USA and Canada.

The shipping costs are based on the current shipping tariffs of the Post and were updated as of 02/01/2021.
By agreement, the ordered goods can also be picked up in 3003 Gablitz Austria or a meeting point for handover in the vicinity of Vienna or Lower Austria can be arranged. To do this, choose the shipping option "Collection by arrangement" (Abholung nach Vereinbarung).
d) Agreed delivery times are basically only reference dates, unless they have been expressly promised in writing as fixed dates.
e) If the desired goods are not available or cannot be delivered within a reasonable delivery period, the customer will be informed immediately by musterAG.com. The customer is then entitled to withdraw from the contract and any purchase price already paid will be refunded.
f) The goods are delivered by post, USP or DHL. After agreement, the ordered goods can also be picked up by yourself.
a) All prices posted on our website are inclusive of 20% VAT and are therefore retail prices.
b) The prices, subject to mistakes and errors at the time of the Online ordering viamusterAG.com or contained on the order confirmation, are with a validity of 14 days.
c) If we are forced because of an error or mistake to raise the price after the order is accepted, the Purchaser will be informed about the delay by musterAG.com and has the right to withdraw from the contract.
6. Right of Withdrawal
a) In accordance with the provisions of the Distance Selling Act (§ 5a KSchG and § 12 FAGG), the consumer has the right to withdraw from the contract within a period of 14 days from receipt of the goods.
b) Goods made according to individual customer specifications (eg: printing of individual designs, individual sewing orders, etc.) are excluded from this provision. The statutory warranty provisions remain unaffected.

e) In the event of withdrawal, the goods must be returned to us by the Buyer immediately and in any event not later than 14 days from the date on which you inform us of the cancellation of this contract.
The costs of the return are borne in principle by the customer. Exemptions require the written form.
a) Should it come, despite our high quality standards to complaints, we will in accordance with the statutory warranty provisions for defects guarantee replacement or refund. The warranty applies only to defects that at the time of handing over the goods were already in place.
b) This does not apply to defects caused by improper handling of the goods (such as too hot washing).
c) The statutory warranty period lasts 24 months from delivery of the goods.
8.1. Contact us
If you contact us via the form on the website or by e-mail, your data will be stored for six months to process the request and in case of follow-up questions. We will never share this information without your consent.
8.2. Data storage
We point out that for the purpose of easier shopping and subsequent contract processing by the web shop operator in the context of cookies, the IP data (provider, location) of the connection owner are stored.
Data collected via our online shop is stored on our web server. The web server is hosted by 1&1, 1&1 Internet SE, Elgendorfer Str. 57, 56410 Montabaur, Germany.
Depending on the use of our offer, the following personal data will be stored:

Newsletter: name, e-mail address
Registration: name, e-mail address
For the purpose of the contract processing the following data are stored with us:
Order: name, address, e-mail address, Date of birth*, Credit card number **
* The date of birth is used on the one hand to check the age of majority of the customer, on the other hand in order to be able to clearly identify the debtor in case of late payment or non-payment.
** The credit card number is stored exclusively by the implementing bank / payment service provider.
The data provided by you are required to fulfill the contract or to carry out pre-contractual measures. Without this data we cannot conclude the contract with you via the webshop.
A transfer of data to third parties does not take place, with the exception of the transmission of the credit card data to the processing bank / payment service provider for the purpose of debiting the purchase price and to the transport company / shipping company commissioned by us to deliver the goods, as well as to our tax advisor to fulfill our tax obligations.
After termination of the shopping process, the data stored with us will be deleted. In the case of a contract, all data from the contractual relationship are stored until the expiry of the tax retention period (7 years).
In addition, data such as name, address, purchased goods and date of purchase will be stored until the end of product liability (10 years). Data processing takes place on the basis of the statutory provisions of § 96 (3) TKG and Art. 6 para. 1 lit a (consent) and / or lit b (necessary for fulfillment of the contract) of the GDPR.
8.3. Encryption with https
We use https to transfer data securely on the Internet. By using TLS (Transport Layer Security), an encryption protocol for secure data transmission over the Internet, we can ensure the protection of confidential data. You acknowledge the use of this security of data transfer by the small lock symbol and the use of "https" as part of our web address.
Our website uses so-called cookies. These are small text files that are stored on your device using the browser. They do no harm.
If you do not want this, you can set up your browser so that it informs you about the setting of cookies and you allow this only in individual cases.
Disabling cookies may limit the functionality of our website.
8.5. Web Analysis - Preliminary Information
Currently we do not use the web analytics service (yet). Once the service is up and running, its data is processed as follows:
Our website uses features of the web analytics service Google Analytics, the company Google Inc. 1600 Amphitheater Parkway Mountain View, CA 94043, USA. For this purpose, cookies are used that allow an analysis of the use of the website by your users. The information generated in this way is usually transmitted to a Google server in the USA and stored there.
You can prevent this by setting up your browser so that no cookies are stored.
The IP address provided by Google Analytics as part of Google Analytics will not be merged with other Google data.
We have concluded a corresponding contract data processing contract with the provider.
The relationship with the web analytics provider is based on the standard contractual clauses / adequacy decision of the European Commission with USA, the EU-US Privacy Shield.
The data processing takes place on the basis of the legal regulations of the § 96 Abs 3 TKG as well as the art 6 Abs 1 a) (consent) and / or f (legitimate interest) of the DSGVO.
Our concern in the sense of the DSGVO (legitimate interest) is the improvement of our offer and our website. Since the privacy of our users is important to us, the user data is pseudonymized.
The user data is kept for a period of 14 months and then deleted.
You have the opportunity to subscribe to our newsletter via our website. For this we need your e-mail address and your declaration that you agree with the subscription to the newsletter. Once you have subscribed to the newsletter, we will send you a confirmation email with a link to confirm your registration (double opt-in).
We use the data stored in the registration for the newsletter solely for our newsletter.
For sending out newsletters, we use the Mailchimp program of The Rocket Science Group, LLC, 675 Ponce de Leon Ave. NE, Suite 5000, Atlanta, GA 30308, USA.
To measure success and improve a sent newsletter, data such as location, opening and click behavior are stored in the newsletter.
The completed contract data processing contract with the mailchimp provider ensures compliance with the European Data Protection Act.
You can cancel the subscription to the newsletter yourself at any time by unsubscribing from the newsletter or by sending an e-mail to: email@example.com
We will immediately delete your data in connection with the newsletter dispatch.
8.7. Your rights
In principle, you have the rights to information, correction, deletion, restriction, data portability, revocation and opposition.
